DEPOSIT: At the conclusion of the BID opening on December 2, 2020, the County will notify you by phone and/or email if you are the successful BIDDER for this property. At that time, you will be required to deliver a cash or certified check, payable to Josephine County, in the amount of 20% of the BID offer, no later than 4:00 p.m. on December 2, 2020, to the Josephine County Treasury and Tax Office, at the address listed above. No personal or business checks will be accepted. At that time, you will be issued a Sheriff's Certificate of Sale. If your deposit is not received by 4:00 p.m. on December 2, 2020, your bid will be forfeited and the property will be offered to the next-highest bidder.
BALANCE: The balance of the total purchase price is payable as follows:
Properties sold for less than $20,000 will be for cash or cash equivalents only, with a required deposit of 20% of the BID offer. Properties sold for $20,000 or more may be purchased for cash or under a land sale contract, with terms as follows: Cash down at time of sale, 20% of the BID offer; balance payable in equal monthly installments: $20,000 to $40,000 purchase price is a 3 year term; $40,001 to $60,000 purchase price is a 4 year term; $60,001 and greater is a 5 year term, from date of sale; interest rate is 9% per annum. Josephine County does not furnish a survey or provide title insurance in any form. Conveyance shall be by quitclaim deed.

_____ FOR CASH SALES: BIDDER shall pay the full balance of the purchase price at the Josephine County Treasury and Tax Office, 500 NW 6th Street, Room 70, Courthouse, C Street Entrance, Grants Pass, Oregon, along with a recording fee ($91.00 for first page and $5.00 for each additional page) for recording a quitclaim deed to be executed by Josephine County in favor of Purchaser. The full balance plus the recording fee is due no later than December 7, 2020, at 4:00 p.m. After receipt of payment of the full purchase price and recording fee, the Josephine County Board of Commissioners will execute a quitclaim deed to the property in favor of the Purchaser and will direct that the deed be delivered to the Purchaser after being recorded by the Josephine County Clerk.
_____ FOR INSTALLMENT SALES: BIDDER shall pay the full balance of the purchase price as follows: BIDDER/Purchaser shall pay the full balance of the purchase price under a Land Sale Contract, which County shall provide to Purchaser. Not later than December 11, 2020, Purchaser shall return the signed contract to County Josephine County Treasury and Tax Office, 500 NW 6th Street, Room 70, Courthouse, C Street Entrance, Grants Pass, Oregon. Purchaser shall pay the cost of recording a Memorandum of the Contract ($91.00 for first page and $5.00 for each additional page); payment shall be included with and in addition to the first monthly payment to County under the Contract. At the time Purchaser has complied with all terms of the Contract, the County shall convey its interest by quitclaim deed from County to Purchaser.
TERMS OF SALE
If the BID is accepted for a cash sale, and BIDDER fails to pay the full balance of the purchase price within the time and in the manner set forth hereinabove, all rights of the BIDDER in said real property shall cease and all right, title and interest in said real property shall continue to remain vested in Josephine County, free of any claim or equity in the BIDDER or those claiming through him/her, and all monies deposited by BIDDER (20% of purchase price) shall be retained by County.
If the BID is accepted for an installment sale, and BIDDER fails to enter into a signed contract with County within the time and in the manner set forth hereinabove, all rights of the BIDDER in said real property shall cease and all right, title and interest in said real property shall continue to remain vested in Josephine County, free of any claim or equity in the BIDDER or those claiming through him/her, and all monies deposited by BIDDER (20% of purchase price) shall be retained by County.
Properties are sold on an “as is, where is” basis. The sale of this property is subject to any existing special assessments, restrictions, reservations and/or easements. Josephine County shall convey only such right, title and interest in said real property as is now vested in Josephine County. Conveyance will be made by Quitclaim Deed. No warranty or guarantee, expressed or implied, is made regarding condition of title (encumbrances, liens, easements, etc.), ability to use a property for any particular purpose pursuant to Oregon land use law, existence of legal access, location of property boundaries or any other matter concerning a property. Title insurance shall be at the option and expense of the purchaser. It is recommended that the Offeror secures a preliminary title report and thoroughly investigates a property prior to purchasing it from County.
ORS 93.040(2) “THE PROPERTY DESCRIBED IN THIS INSTRUMENT MAY NOT BE WITHIN A FIRE PROTECTION DISTRICT PROTECTING STRUCTURES. THE PROPERTY IS SUBJECT TO LAND USE LAWS AND REGULATIONS THAT, IN FARM OR FOREST ZONES, MAY NOT AUTHORIZE CONSTRUCTION OR SITING OF A RESIDENCE AND THAT LIMIT LAWSUITS AGAINST FARMING OR FOREST PRACTICES, AS DEFINED IN ORS 30.930, IN ALL ZONES. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE PERSON TRANSFERRING FEE TITLE SHOULD INQUIRE ABOUT THE PERSON’S RIGHTS, IF ANY, UNDER ORS 195.300, 195.301 AND 195.305 TO 195.336 AND SECTIONS 5 TO 11, CHAPTER 424, OREGON LAWS 2007, SECTIONS 2 TO 9 AND 17, CHAPTER 855, OREGON LAWS 2009, AND SECTIONS 2 TO 7, CHAPTER 8, OREGON LAWS 2010. BEFORE SIGNING OR ACCEPTING THIS INSTRUMENT, THE PERSON ACQUIRING FEE TITLE TO THE PROPERTY SHOULD CHECK WITH THE APPROPRIATE CITY OR COUNTY PLANNING DEPARTMENT TO VERIFY THAT THE UNIT OF LAND BEING TRANSFERRED IS A LAWFULLY ESTABLISHED LOT OR PARCEL, AS DEFINED IN ORS 92.010 OR 215.010, TO VERIFY THE APPROVED USES OF THE LOT OR PARCEL, TO VERIFY THE EXISTENCE OF FIRE PROTECTION FOR STRUCTURES AND TO INQUIRE ABOUT THE RIGHTS OF NEIGHBORING PROPERTY OWNERS, IF ANY, UNDER ORS 195.300, 195.301 AND 195.305 TO 195.336 AND SECTIONS 5 TO 11, CHAPTER 424, OREGON LAWS 2007, SECTIONS 2 TO 9 AND 17, CHAPTER 855, OREGON LAWS 2009, AND SECTIONS 2 TO 7, CHAPTER 8, OREGON LAWS 2010.”
